3. Joining and eligibility

3.1You must be at least [CONFIRM: minimum age, e.g. 16] years old to hold an adult membership. Members aged [CONFIRM: age range, e.g. 16–17] need consent from a parent or guardian, who must sign on their behalf.

3.3When joining, you must give accurate and complete information, including your name, date of birth, contact details and emergency contact, and tell us promptly if any of these change.

3.4You will be asked to complete a health questionnaire. If you have a medical condition, injury, are pregnant or are unsure whether exercise is suitable for you, you should get advice from your GP or a qualified medical professional before using the facilities.

3.5[CONFIRM: is an induction required before using the gym floor? e.g. "New members must complete an induction with a member of staff before training unsupervised."]

3.6Membership is personal to you. It cannot be shared, lent or transferred to anyone else.

3.7We may refuse a membership application at our discretion, for example where a person has previously had their membership ended for breaching these terms.

5. Fees and payment

Joining fee

5.1[CONFIRM: is there a joining fee? If so, how much, and is it refundable?]

Monthly fees

5.2Monthly fees are paid by Direct Debit [CONFIRM: or card / other method], collected on or around [CONFIRM: collection date, e.g. "the 1st of each month" or "the same date you joined"].

5.3When you join, you may be asked to pay a pro-rata amount covering the period up to your first full monthly payment.

5.4Direct Debit payments are protected by the Direct Debit Guarantee. Cancelling your Direct Debit with your bank does not cancel your membership — please follow the cancellation process in section 7.

Missed payments

5.5If a payment fails, we will contact you and try to collect it again. [CONFIRM: any admin fee for a failed payment — this must be a fair, reasonable amount reflecting your actual costs]

5.6We may suspend your access until any outstanding amount is paid. If payments remain unpaid, we may end your membership and take reasonable steps to recover the money owed, which may include passing the debt to a collection agency. [CONFIRM: after how many missed payments / how long]

Price changes

5.7We may change our membership prices from time to time. We will give you at least [CONFIRM: notice period, e.g. 30 days] written notice of any increase to your monthly fee. If you do not wish to continue at the new price, you may cancel your membership [CONFIRM: e.g. "without penalty before the increase takes effect, even during a minimum term"].

5.8All prices include VAT where applicable.

6. Your right to cancel (cooling-off)

6.1If you join online or over the phone, you have the legal right to cancel within 14 days of the day your membership agreement is made, without giving a reason. This is set out in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

6.2To cancel within this period, contact us by email or in writing (see section 22) with your name and the date you joined.

6.3If you ask to start using the gym during the 14-day period and then cancel, we may deduct a proportionate amount for the days you had access. We will refund anything else you have paid within 14 days of you telling us you wish to cancel.

6.4[CONFIRM: does the same 14-day cooling-off apply if you join in person at the gym? This is a business decision — the legal right above applies to online/phone sign-ups.]

7. Minimum term and cancelling your membership

Minimum term

7.1[CONFIRM: "Our memberships are rolling monthly with no minimum term" OR "Some memberships have a minimum term of X months, shown at sign-up"]

7.2If your plan has a minimum term, you agree to pay the monthly fee for the whole of that term, unless you are entitled to cancel early under these terms or the law.

How to cancel

7.3After any minimum term, you can cancel by giving us [CONFIRM: notice period, e.g. "one full calendar month's"] notice [CONFIRM: how — e.g. "by email to memberships@yourgymfitness.co.uk", "in person at reception" or "through your online account"].

7.4We will confirm your cancellation in writing. Please keep this confirmation. Any payments due during your notice period will still be collected, and you can continue using the gym until your membership ends.

Cancelling early in special circumstances

7.5If you are within a minimum term, we will consider early cancellation if you can no longer use the gym because of [CONFIRM: e.g. "serious illness or injury (with a medical note), moving more than X miles away (with proof of address), or redundancy"]. Please speak to us — we will always try to be fair.

7.6In the event of a member's death, the membership will end immediately and no further payments will be taken.

8. Freezing your membership

8.1[CONFIRM: can members freeze? If yes: minimum and maximum freeze length, how many times per year, any monthly freeze fee, notice needed, and whether a minimum term is extended by the freeze period.]

8.2Requests to freeze must be made [CONFIRM: how and how far in advance]. Freezes for medical reasons may need supporting evidence.

8.3Your access will be paused during the freeze and will restart automatically at the end of it, along with your normal payments.

9. Opening hours and access

9.1Our current opening hours are:

  • YourGym Lytham — Monday to Friday 5am–10pm, Saturday and Sunday 7am–7pm.
  • YourGym Kirkham — open 24 hours, every day. [CONFIRM: staffed hours]

9.2Hours may be different on bank holidays and over Christmas and New Year. We will publish any changes in advance at the gym, on our website and on social media.

9.3Your access device is personal to you. You must not lend it to, or let in, anyone else. [CONFIRM: charge for a lost or replacement access device, if any]

9.4Please tell us straight away if your access device is lost or stolen so we can deactivate it.

10. 24-hour access at Kirkham

10.1Outside staffed hours, the gym is unstaffed. By training at these times you accept that no staff will be on site to supervise or help you.

10.2For everyone's safety during unstaffed hours:

  • Only enter using your own access device, and never hold the door open for, or allow entry to, anyone else ("tailgating").
  • Do not attempt exercises or weights beyond your ability, and use a spotter only if one is legitimately present.
  • Know where the emergency exits, first-aid kit, [CONFIRM: defibrillator, if on site] and [CONFIRM: emergency/panic alarm, if fitted] are.
  • In an emergency, call 999 first.
  • [CONFIRM: any age restriction for unstaffed hours, e.g. "Members under 18 may only train during staffed hours."]

10.3The gym is monitored by CCTV at all times (see section 17). Any misuse of 24-hour access may lead to suspension or cancellation of your membership.

11.1Classes run to the timetable published on our website and at the gym. Timetables, instructors and class types may change from time to time.

11.3If you can't attend a class you've booked, please cancel at least [CONFIRM: e.g. 12 hours] before it starts so someone else can have your place. [CONFIRM: any no-show policy, e.g. booking restrictions after repeated no-shows, or a charge for paid classes]

11.4Please arrive on time. For your safety, instructors may refuse entry to anyone who arrives after the warm-up has finished.

11.5We may cancel a class because of low numbers, instructor absence or circumstances beyond our control. We will try to let booked members know as early as possible.

12. Personal training

12.1Personal training is not included in membership unless stated, and is booked and paid for separately.

12.2[CONFIRM: are personal trainers employed by YourGym or self-employed? If self-employed, add: "Our personal trainers are self-employed. Any personal training agreement, including prices and cancellation terms, is between you and your trainer."]

13. Guests, free trials and offers

13.1[CONFIRM: guest policy — are guests allowed? Do they pay a day rate, need to sign in, and must they be over a certain age?]

13.2Anyone using the gym on a guest pass, free trial or promotional offer must register in advance and agrees to follow these terms, including the health and safety and code of conduct sections.

13.3Free trials and promotional offers have their own terms, which will be shown with the offer. Unless stated otherwise, offers are limited to one per person, cannot be used with any other offer, have no cash value, and may be changed or withdrawn at any time.

14. Health and safety

14.1You are responsible for making sure you are fit and well enough to exercise. Please tell staff, or your class instructor, about any medical condition or injury that could affect your training.

14.2Stop exercising immediately and seek help if you feel unwell, dizzy, faint or in pain.

14.3Please:

  • Use equipment only for its intended purpose and as shown in your induction or on the equipment instructions.
  • Report any faulty or damaged equipment to staff straight away and don't use it.
  • Wear suitable, clean training clothes and enclosed training shoes. [CONFIRM: any specific dress-code rules]
  • Wipe down equipment after use and return weights and accessories to their racks.
  • Use collars on loaded bars and never drop weights except where this is allowed.
  • Keep walkways and fire exits clear.

14.4You must not use the gym while under the influence of alcohol or drugs. The use, possession or supply of illegal drugs or performance-enhancing substances on our premises is strictly prohibited.

14.5Smoking and vaping are not allowed anywhere inside the gym.

14.6Please follow any reasonable instructions from staff about health and safety, and leave the building immediately if the fire alarm sounds.

15. Code of conduct

15.1YourGym is a welcoming place for everyone. We ask all members to treat other members, guests and staff with courtesy and respect.

15.2The following are not allowed:

  • Abusive, threatening, discriminatory or intimidating behaviour, language or gestures — in person or online.
  • Harassment of any kind, including unwanted comments or attention.
  • Taking photos or videos of other members or staff without their consent, and any filming at all in changing rooms or toilets.
  • Theft, or deliberate damage to equipment or property.
  • Letting anyone into the gym who is not a member or registered guest.
  • Hogging equipment for long periods at busy times — please share and allow others to work in.
  • Selling goods or services, or coaching others for payment, without our written permission.

15.3Please keep noise to a reasonable level and use headphones for your own music.

15.4Breaking this code of conduct may lead to a warning, suspension or the end of your membership (see section 18).

16. Lockers and personal belongings

16.1Lockers are for use while you are training only. [CONFIRM: do members bring their own padlock, or are lockers key/code operated?]

16.2Lockers left locked after closing time [CONFIRM: or after X hours at Kirkham] may be opened and the contents removed. Items will be kept for [CONFIRM: e.g. 14 days] before being donated or disposed of.

16.3Please don't bring valuables to the gym. We are not responsible for the loss of, or damage to, personal belongings unless this is caused by our negligence.

17. CCTV, photos and your data

17.1CCTV operates at our gyms for the safety and security of members, staff and property, and to help prevent and detect crime. There are no cameras in changing rooms or toilets.

17.2We collect and use your personal data to manage your membership, take payments, keep the gym safe and, where you agree, send you news and offers. Full details of how we use, store and protect your data — and your rights under UK data protection law — are in our Privacy Policy.

17.3We sometimes take photos or videos at the gym for our website and social media. We will always try to let members know when this is happening. If you would prefer not to appear, please tell the person taking them or a member of staff.

18. Suspending or ending membership

18.1We may suspend or end your membership, with immediate effect if necessary, if you:

  • seriously or repeatedly break these terms or the code of conduct;
  • behave in a way that puts the safety or wellbeing of others at risk;
  • share your membership or access device, or let anyone in without permission;
  • give false information when joining; or
  • fail to pay amounts you owe (see section 5).

18.2Where reasonable, we will speak to you first and give you a chance to explain. If your membership is ended because you have broken these terms, [CONFIRM: whether any fees are refunded — e.g. "no refund will be given for the remainder of the month"], and we may refuse future applications to join.

18.3We may also end memberships if we close a gym permanently. We will give you as much notice as possible and refund any fees you have paid for periods after the closure.

19. Our liability to you

19.1Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law.

19.2We will provide our services with reasonable care and skill. We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill.

19.3We are not responsible for:

  • injury, loss or damage caused by you not following these terms, staff instructions or safety guidance, or by exercising beyond your ability;
  • loss that was not foreseeable to you and us when you joined; or
  • loss or damage to personal belongings, except where caused by our negligence (see section 16).

19.4You are responsible for any damage you deliberately or carelessly cause to our equipment or premises, and we may ask you to pay reasonable repair or replacement costs.

20. Changes to facilities and closures

20.1We may need to close all or part of a gym, or change equipment, layout or services, for maintenance, refurbishment, staff training, events or safety reasons. We will give advance notice where we can.

20.2Short closures will not normally affect your monthly fee. If a gym is closed for longer than [CONFIRM: e.g. 7 consecutive days] for reasons within our control, [CONFIRM: what you offer — e.g. "we will offer a pro-rata credit or access to our other site"].

20.3We are not responsible for any delay or failure to provide our services caused by events outside our reasonable control, such as severe weather, power cuts, flooding or government restrictions. If this continues for more than [CONFIRM: e.g. 30 days], you may cancel your membership without penalty.

21. Changes to these terms

21.1We may update these terms from time to time — for example, to reflect changes in the law, our services or how we operate.

21.2We will tell you about any significant change at least [CONFIRM: e.g. 30 days] before it takes effect, by email and on this page. If a change is to your disadvantage, you may cancel your membership before it takes effect without any early cancellation charge.

21.3The latest version of these terms will always be available on this page, with the date it was last updated.

22. Complaints and contacting us

22.1We want you to enjoy being a member. If something isn't right, please speak to a member of staff first — most issues can be sorted quickly.

22.2If you'd prefer to put it in writing, or you're not happy with the response, please contact us:

  • Lytham: memberships@yourgymfitness.co.uk · 01253 732400

23. General legal terms

23.1If any part of these terms is found to be invalid or unenforceable, the rest will continue to apply.

23.2If we don't enforce any of our rights straight away, we can still enforce them later.

23.3We may transfer our rights and obligations under these terms to another organisation, for example if the business is sold. We will tell you if this happens, and it will not affect your rights under these terms.

23.4This agreement is between you and us. No other person has any rights to enforce any of its terms.

23.5These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales.
